Terms of Service

1. Agreement
By downloading, installing, or using the Shoe Health app (the "App"), you ("you", "user") agree to these Terms of Service (the "Terms"). If you do not agree, do not use the App.
The App is distributed through the Apple App Store. Your download and use is also governed by Apple's Licensed Application End User License Agreement (the "Apple EULA"). In case of conflict, these Terms govern, except where the Apple EULA explicitly takes precedence.
2. Eligibility
You must be at least 13 years old to use Shoe Health. If you are in the European Economic Area (EEA), the United Kingdom, or another jurisdiction with a higher digital-consent age, you must meet that age (typically 16). If you are under the age of majority where you live, you may use the App only with the consent of a parent or legal guardian.
3. License
Subject to these Terms, Shoe Health grants you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices that you own or control, for personal, non-commercial use. You agree not to:
- Copy, modify, distribute, sell, rent, lease, or sublicense the App;
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive source code or underlying ideas;
- Remove or obscure any copyright, trademark, or other proprietary notices;
- Use the App in violation of any applicable law or regulation.
4. In-App Purchases and Subscriptions
Shoe Health offers a free tier and Premium plans purchased through the Apple App Store. All purchases are processed by Apple under your Apple ID account.
4.1 Plans and Pricing
- Free — up to 3 shoes; core tracking features.
- Premium Monthly — USD $2.99 / month, with a 7-day free trial for new subscribers.
- Premium Yearly — USD $14.99 / year, no free trial.
- Premium Lifetime — USD $39.99 one-time purchase. Not a subscription; does not auto-renew.
Prices in your local currency are shown in the App Store at the time of purchase and may differ from the U.S. dollar prices listed above. Apple may apply taxes and currency conversion.
4.2 Free Trial (Premium Monthly only)
The 7-day free trial is available only to first-time subscribers of Premium Monthly. Unless you cancel at least 24 hours before the trial ends, your subscription will automatically convert to a paid subscription at the standard Monthly price, and your Apple ID will be charged. Re-subscribing after a previous trial may not qualify you for an additional free trial.
4.3 Auto-Renewal
Premium Monthly and Premium Yearly subscriptions automatically renew at the end of each billing period at the then-current price unless cancelled at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours prior to the end of the period.
4.4 Managing and Cancelling Subscriptions
You can manage or cancel your subscription at any time directly on your device: Settings → [your name] → Subscriptions → Shoe Health → Cancel Subscription.
Cancelling stops future renewals; you keep Premium access until the end of the period you have already paid for. No partial refunds are issued for unused time.
4.5 Price Changes
Apple may notify you of subscription price changes in accordance with App Store policies. Where required by law, your continued subscription after the new price takes effect constitutes consent. You may cancel before the change takes effect.
4.6 Refunds
All payments are final and non-refundable except where required by applicable law. Refund requests are handled exclusively by Apple — submit one at reportaproblem.apple.com.
4.7 Premium Lifetime
Premium Lifetime is a single, one-time payment that grants Premium access for the lifetime of the App on the Apple ID used at purchase. It is not a subscription and does not auto-renew. Lifetime access is restored on additional or future devices using the same Apple ID via "Restore Purchases" inside the App.
5. Intellectual Property
The App and all of its content, features, and functionality — including without limitation source code, design, algorithms, text, graphics, icons, illustrations, and user-interface elements — are the exclusive property of Robert Iulian Basamac and are protected by copyright, trademark, and other intellectual-property laws.
You acknowledge that you receive no ownership rights in the App. Any feedback, suggestions, or ideas you submit may be used by Shoe Health without obligation to you.
6. Acceptable Use
You agree not to use the App to violate any applicable law, infringe any third-party rights, distribute malware, or interfere with the App's normal operation, security, or other users' enjoyment.
7. Apple-Specific Terms
Where you obtain the App from the Apple App Store, the following terms apply in addition to the rest of these Terms. They are required by Apple for App Store distribution:
- Acknowledgement. These Terms are between you and Robert Iulian Basamac, not Apple. Apple is not responsible for the App or its content.
- Scope of License. You may use the App on any Apple-branded device that you own or control, as permitted by the Apple Usage Rules in the App Store Terms of Service.
- Maintenance and Support. Robert Iulian Basamac is solely responsible for any maintenance and support services for the App. Apple has no obligation to furnish maintenance or support.
- Warranty. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, who will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
- Product Claims. Robert Iulian Basamac, not Apple, is responsible for addressing claims relating to the App, including product-liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims arising under consumer-protection or similar legislation.
- Intellectual-Property Claims. In the event of any third-party claim that the App infringes that party's intellectual-property rights, Robert Iulian Basamac, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any such claim.
- Third-Party Beneficiary. You acknowledge that Apple and its subsidiaries are third-party beneficiaries of these Terms and will have the right to enforce them against you.
8. Disclaimer of Warranties
The App is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. Shoe Health does not warrant that the App will be error-free or uninterrupted, or that any defects will be corrected.
Wear, distance, and retirement estimates produced by Shoe Health are statistical guidance — not medical, biomechanical, or professional advice. Always use your own judgment and consult a qualified professional regarding running gear, training load, and injury prevention.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Shoe Health and its developer shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, goodwill, or use, arising out of or in connection with the App. The total aggregate liability for direct damages shall not exceed the amount you paid for the App and in-app purchases in the twelve (12) months preceding the claim, or, if no such payment was made, USD $25.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you.
10. Termination
These Terms apply until terminated. They terminate automatically if you fail to comply with any provision. Upon termination, you must stop using the App and delete it from all devices. Sections 5, 8, 9, and 12 survive termination.
11. Changes to the App and to These Terms
Shoe Health may modify, suspend, or discontinue the App or any feature at any time. We may also update these Terms from time to time. When we do, we will update the "Effective Date" above and announce significant changes inside the App or on the App Store listing. Continued use of the App after a change constitutes acceptance.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of Romania, without regard to conflict-of-laws principles. Any dispute arising out of or relating to the App or these Terms shall be submitted to the exclusive jurisdiction of the competent courts of Bucharest, Romania, except where mandatory consumer-protection laws of your country of residence provide otherwise.

Your use of the App is also subject to our Privacy Policy, which explains how we handle your data.
